The most recent trial date in the criminal case against former San Ramon Valley teacher and cheer coach Nicholas Moseby is poised to be the final one after multiple delays for various reasons including scheduling and attorneys’ requests for additional time.
The process is set to kick off with jury selection and pre-trial motions on Feb. 24, according to the Contra Costa District Attorney’s office, with the upcoming date being the sixth time the trial has been scheduled in the years since Moseby was initially arrested on child sex abuse charges in September 2022. He has been out on bail since December 2022.
Moseby is facing three felony charges for lewd acts upon a child, one of whom was under the age of 14, one felony charge for distributing lewd matter to a minor, two misdemeanor charges for child molestation, and one misdemeanor charge for sexual battery. He has pleaded not guilty.
Additional details into the allegations against Moseby emerged in a civil complaint that was filed in November, 2024 on behalf of the three alleged victims, all of whom are minors. The civil case also alleges negligence against the San Ramon Valley Unified School District for hiring and failing to appropriately investigate complaints against Moseby, as well as the San Ramon cheerleading gym NorCal Elite. Both organizations have denied liability for the incidents in court filings.
The upcoming trial date was preceded by a readiness conference on Feb. 10. A case management conference in the new civil case is set for March 27.
