Editor’s note: On Aug. 6, 2014, William Hogarty, 50, a former Livermore mortgage broker, entered a plea of “no contest” and was found guilty of a misdemeanor crime, a violation of California Civil Code section 2944.6, according to court documents and the District Attorney’s office. After stipulating to the factual basis of the 12 felony counts of fraud, three counts of theft and one count of perjury, which he was charged with in April 2013, all felony counts were dismissed. Section 2944.6 requires certain specific written disclosures to borrowers prior to mortgage loan modifications. Alameda County Deputy District Attorney David Lim, who prosecuted the case, said that restitution was the goal of the agreement. Hogarty agreed to pay a total of $56,125 to 12 victims from Alameda County. Sentencing is set for November 18.

A former financier was set for a preliminary hearing Monday on an allegation of attacking and threatening his former roommate at his Livermore mansion. Instead, he was led from the courtroom in handcuffs, facing 12 new counts of real estate fraud, three counts of criminal conspiracy and one count of perjury.
That’s in addition to a civil case filed by several people who claimed he defrauded them and they lost their homes as a result.
The financier, William Hogarty, 49, is the owner of the now defunct OF Lending, which claimed to do short-pay refinancing (SPR), allowing homeowners who were underwater on their homes to renegotiate with their banks.

Court documents claim Hogarty and co-defendants James Allen Rivera Jr., Gregory Wayne Lomba and James Torpey conspired to defraud people of their property, that they conspired to commit false advertising, and conspired to collect advance fees.
The four are also charged with a combined 12 counts of grand theft, for taking more than $69,000 from clients who hoped to save their homes.

In a recent interview with the Pleasanton Weekly, He said he was not responsible for any of the losses to OFL’s clients.
“None of these clients were my clients. They were all agents’ clients,” he said, blaming Rivera for the misdealings. “He was the man behind 80% of the problems. I paid dearly for that.”
He also blamed the victims, saying some of them now say they don’t know what they signed.
He appeared on a Bay Area television show, “View from the Bay,” in January 2010, where he promoted his company, and claimed he’d saved one woman $370,000 by doing a short-pay refinance. On the show, he advised people to never submit false or untruthful information.
“The truth is always best,” he told the show’s hosts.
Hogarty, Rivera, Lomba and Torpey also face additional time under a California enhancement that increases possible prison time for white collar crimes. The four, court documents say, had a “pattern of related felony conduct” that involved “the taking of and results in the loss by another of more than $100,000.”
The 2005 Mr. California Bodybuilding Champion, still faces felony aggravated assault and threats charges, in which his former roommate claims he was choked until he nearly blacked out. The preliminary hearing was postponed when he was arrested on the new charges.
He has since been released on bail, and the $250,000 bond from his criminal charges was renewed. Lomba and Torpey were each being held on a $100,000 bond, and Rivera could not be located.
In the civil case, 22 people have claims under the lawsuit that now includes him. Virtually every employee of the company was named in the suit, — along with Riviera, Tiffany Carr and Lomba. That case alleges clients paid upfront fees ranging from $1,200 to $12,000, for the company’s short-pay refinancing services.
At least three people have already won judgments against him.
He sold his home in a short sale, exactly the kind of deal he told clients they could avoid. The 12,978-square-foot mansion, with eight bedrooms, a 12-car garage and swimming pool was promoted as Northern California’s answer to the Playboy mansion. It was the scene of risque parties, such as the Fallen Angels Lingerie Party and Mardi Gras at the Mansion. He said those parties were in full compliance with the law.

So I guess we can agree that you (Christy Hogarty) and your husband, Bill Hogarty, robbed your mortgage lendersssssss when you did a short sale on your mansion, right, because they didn’t get back the money they loaned you, right? The difference between you robbing your mortgage companies and we victims is that we paid our mortgages the whole time while apparently you did not. We were also living in your standard and modest house while paying our mortgages while you all lived in a fat mansion and weren’t paying your mortgage company for a few years while still using this mansion (that you weren’t paying for) to bring in tens of thousands of dollars hosting disgusting parties requiring local law enforcement resources that you weren’t paying for since your husband admitted you didn’t pay your property taxes. Let’s not forget that you both also robbed the bank that loaned you money on the office building that you stopped paying on and that you used to defraud people like us and that ultimately the bank had to foreclose on you and throw you out. While not paying the mortgage on the building, you still collected rent from the other tenants so you profited in all sorts of ways when you robbed this bank. You didn’t tell the tenants that the building was in foreclosure and then when you were thrown out, you kept their security deposits too.
I don’t know how you all can show your faces around this community where you’ve done so much harm to so many. Think about the impact all of this is going to have on your children that your husband claims to love so much and stop using them as pawns in your newest MLM venture.
It warms my heart to hear that Hogarty and his entire clan are finally getting what they deserve. I was one of the first people to file claims against OF Lending and his brainless followers. I filed claims with every agency I could, including the DA and the Board of Real Estate. I did a huge amount of research on Hogarty. Unfortunately, it was after he stole $6,000.00 from me in one of his refinance scams. I was amazed and sickened by all of the horrible things I found about him on the internet. He has a history of scams that go back many many years. It’s one terrible story after another and spans across multiple states. I started a few blogs about what he had done to me. I received a shocking amount of responses from people he had also screwed over. So many sad stories. He basically took them for every penny they had, never did anything he and his clan had promised and ended up losing their homes in the end. I helped as many of them as I could. Hogarty and everyone involved with following him, are extremely sick and disgusting people.
In their twisted sick mind, they still believe they have done nothing wrong. His dumb ass wife continues to lie about everything. One of the responses above called it right. I’m not a lawyer or in law enforcement, but surely charging these four, including your husband, doesn’t mean they can’t charge more. You’ve taken on his approach of throwing in numbers to make yourself look credible or like you know what you’re talking about and are even reciting some of his lame excuses as if the economy or mortgage meltdown gave him the right to commit grand theft, fraud, conspiracy and perjury.
You do know they can track who posted on here even when you use an alias, don’t you? Trying to say these crimes are not worth prosecuting is ridiculous. Criminals are prosecuted for far less greater crimes. Only a true narrcisist would feel this way.

Actually you are wrong. I am very sorry on many levels. I have never run as I choose to face this head on. I am the first to admit I have many faults, yet giving up is not one of them. We are in a world that is in deep recession and the hard times will continue until the banks choose to start helping people(not sure they will)second recession comming. I realize I make a great a fall guy, yet I built my mansion in 2000 long before 2009, and bought the boat in 2006 again long before 2009. In the end, we did help many save their home yet it wasnt perfect by any means. I realize I make an easy target, yet FAR from a victom. All my “material” items are gone yet I have an amazing family that I love and love me. My mother in law approached me today and said :”thank you for all you do” See this is what truely drives me. My realtionship with my father took 40 years and many say I am lucky yet I never gave up on him and I happy to see him recieve love he never dreamed of from my daughters. Far more than many and I guess that makes me bad. Yet it wasnt an easy road. In a world that 7 of my 7 couple friends divorced I feel bleesed my wife stood by me (wqe both had to compromise). I am more lucky in that regards to most and never take it for granded. I did not cause the collaspe the US real estate market, yet tried to help. May i ask what you dit to help? I have over 100,000 clients in my career and accept this last run ended badly. I feel horrible for that. I am under alot of judgement yet I face it and dont run. It’s very generous of you to come on here and admit that short pay refis weren’t happening a few years ago when you, your husband and co defendants claimed they were and that banks are only now “starting” and have “started to” do them. If only you and your husband had been this honest a few years ago when you charged people thousands of dollars to do what you have now admitted they weren’t doing.
It’s interesting that you want compassion because you are a mother and you don’t want this to impact your child when the money you and your husband stole from us was out of our children’s college funds and was to pay for food and clothing for them. The houses lost to you and your husband’s fraud were our children’s homes and their futures. While we gave you money that was to support and care for our children, you spent OUR money on having your hair and nails done, designer clothes, vacations, a yacht, sportscar, lavish parties. Are our children any less worthy than yours? Why would any of us care to see anything about what kind of mother you are? Did you care about what our children went without so you could pay for fancy things for yourself with our money?
You are no victim or shield and the billion dollar lawsuits have nothing to do with you other than to prove your all frauds. I do wonder why you weren’t charged and hope that it’s only a matter of time before you are.

Too bad other grandchildren have grandparents that lost their homes because you are a thief and a fraud, homes they probably planned to leave for their families and grandchildren when they are gone. The lady you assaulted was someone’s mother and maybe someone’s grandmother. I know I speak for many when I say that no one cares about your marriage and about the divorce rate among your friends. You love your wife and child so much that you threw her out when she was carrying the child so you could carry on with another woman and reconciled only when you were arrested for viciously assaulting one of her supposed friends. You claim you’ve faced the problem you created head on when you filed a fraudulent bankruptcy and named those you stole from as creditors to avoid having to pay them back and to run away from the mess you created. You lied to the courts about your assets that you hid just so you could avoid paying those you stole from. The 10% of your bail you’ve come up with in cash in the last year exceeds the total amount you paid back to ALL those you defrauded. You claimed to have no money to pay us back but of course you have it when you need it for yourself so you can be comfortable and to avoid taking responsibility for what you claim you’ve faced. You are a coward and liar and a thief. When the market collapsed as it did, you should have adjusted your life style instead of taking advantage of the collapse and people that were hurting because of it and using these people as your prey. You should have been honest and told people what your wife now admits and that banks weren’t working with homeowners but instead you lied and told us/them otherwise to defraud us/them of our hard earned money.

Good morning. My family and I have been silent for the last 2 years as we were un sure as to how to handle all this. First all I am truely sorry for all this. We attempted to help people save their homes and the large banks said no. It was not for a lack of effort. We will go public after the last matter is behind us. It is amazing how alligations and rumors by animious people are looked at as true. For instance, Judy Jacobs, we paid her back and we have the canceled check. For the life of me, I cannot understand so much upset by her when she was paid back. I have the checks in a jpg and more than happy to post if Livermore Patch allows.
I am very sorry for this mess, yet the country is far from clear of the recession and frankly it is because banks wont help people

You did not pay Judy Jacobs back everything you stole from her when you signed her up for a program she didn’t qualify for & you committed grand theft by lying to her face & taking money from her based on these lies. You surely did not pay her back part of what you stole from her because you wanted to, you were forced to. Paying back people you stole from doesn’t make the theft and fraud okay. Under that theory, maybe someone could steal a car from you & return it 2 years later and say they did nothing wrong. Or maybe you could kidnap a person and as long as you return them a few years later it’s okay. Or rob a bank and then return PART of what you stole and pretend that makes it okay.
It’s interesting how in your “silence” you’ve said over & over how you returned EXACTLY “$421,000” to those you stole from, but suddenly you aren’t saying this anymore. Could it be because you told this very lie to the DOJ & that you really refunded less than $30K of the millions you stole? Don’t forget that you tried to do away with refunding additional funds to all others by claiming them as creditors in your FRAUDULENT bankruptcy case that was thrown out.
I’ll post the entire criminal complaint against you where your co-conspirators admit this was all a scam, you knew it & that has the results of the audits of your books done at the taxpayer expense because you tried to defraud the court as you defrauded others.

The program was so great like you said that it didn’t even work for you, yet you never told customers this.
