The Pleasanton Police Department issued a notice about a registered sex offender behaving suspiciously in Pleasanton. Daniel Duran, a 41-year-old San Jose resident, has been frequenting various Pleasanton real estate offices and open homes, posing as a potential homebuyer.

Duran is described as 5-foot, 10-inch tall Hispanic male, with brown hair and brown eyes and weighing 200 pounds. He has a scar on his left forearm and a tattoo on his chest.

He was also seen parked in front of homes for sale and looking into the windows of occupied homes for sale. Female real estate agents, homeowners and their neighbors said Duran contacted them despite being told to contact the proper listing agent. The report said his behavior “prompted fear and suspicion.”

Police Captain Eric Finn said his behavior at an open home made the female real estate agent uncomfortable, and she asked him to leave. She later looked him up through the Megan’s Law Web site which publicly discloses if someone is a sex offender and where that person lives and contacted the police when discovering he was listed.

Finn said Duran was charged with rape by force in 1988 and assault with intent to commit rape in 2000. Details on the charges were unavailable at the time of the report, Finn said. Duran served time in state prison and was released in 2005. He has a history of criminal behavior, which Finn said included violence.

Although he is not wanted for anything at this time, Pleasanton police want the community to be aware of his background.

“That’s the spirit of Megan’s Law,” Finn said. “It gives law enforcement the opportunity to proactively protect. It’s a tool that everyone should feel comfortable using as a resource and this is what it’s all about.”

He continued, “We worry about these folks reoffending. Of course [it’s potentially dangerous] any time you have a sex offender with any kind of suspicious behavior that makes women fearful.”
