The jury trial in a child sexual abuse case against former San Ramon Valley teacher and cheer coach Nicholas Moseby has been delayed yet again, with all parties set to meet later in the month to confer on a new start date.

The trial, initially scheduled for November 2023, has now been rescheduled a total of five times so far. Most recently, it had been set to kick off this Tuesday (Sept. 10).

That date has since been vacated, according to court records, with the defense having asked for additional time to prepare and for a new court date to be set, according to a spokesperson from the Contra Costa County District Attorney’s office.

The delays have been for various reasons related to scheduling, according to the DA’s office, with the court having been unable to accommodate the trial on its previously scheduled Aug. 12 date, which was set after the previous June 24 trial date faced a scheduling conflict between the judge in the case and an expert the defense was seeking to employ.

Prior to that, the trial had been set for March 18 and rescheduled due to a conflict with other cases that the judge and Moseby’s attorneys were involved in. 

Now all parties are set to meet on Sept. 19 in order to discuss a new date that the defense and prosecution, as well as the courts, can all accommodate. 

Moseby has pleaded not guilty to the seven charges for alleged sexual abuse and harassment of minors. He was first arrested in September 2022, and subsequently removed from his position as a biology teacher at Diablo Vista Middle School, on charges brought by the DA’s office on a case that now involves multiple victims. Moseby, 43, of Concord was also a private cheer coach in San Ramon.

Although online court records currently show a “change of plea” entry in the case, the DA’s spokesperson said that there has been no plea change contemplated and the case is still set to proceed to trial.
