A day care in Dublin is facing at least its sixth investigation by the California Department of Social Services, following the death of a 2-year-old boy who was found unresponsive at the facility last month, state officials publicly confirmed for the first time Friday.
The fatality occurred April 15, wherein Dublin Police Services responded to a call for the unresponsive boy at 6351 Dublin Blvd. at 2:33 p.m., Capt. Miguel Campos revealed to the Weekly last week. He identified the business as Brilliant Minds Academy, although the building is marked as Building Kidz of Dublin.
Upon arrival police officers performed CPR on the child, Campos said. The toddler was subsequently transported to a local hospital where he was pronounced dead at 3:18 p.m. that day. Police deemed the incident as non-criminal in nature.
The California Department of Social Services is investigating the case but “cannot comment on ongoing investigations”, according to Jason Montiel of the department’s Public Affairs and Outreach Programs Division.
Since April 2024, the department’s Community Care Licensing Division has completed five complaint investigations regarding Building Kidz of Dublin, according to the department’s website. One of the investigations included an onsite inspection that took place hours before the boy’s death – a separate case spurred by an allegation of “classroom operating out of ratio” received March 17.
During the visit from 11:45 a.m. to 12:30 p.m. April 15, licensing program analyst Jyoti Saini found “no instances of (the) facility operating out of ratio”, based on interviews, observations, record review and closed-circuit video footage provided by the facility, according to the investigation report.
Based on interviews with facility staff, “staff has never exceeded capacity, and additional support staff is always available”, the report states.
“While the allegation may have occurred or is valid, there is no preponderance of evidence to prove the alleged violation”, according to the report, which ultimately finds the allegation unsubstantiated.
Previously the department substantiated two complaints June 26, 2024 alleging that “due to lack of supervision, child was injured”, according to the reports.
Other investigations brought on by allegations — ultimately deemed unsubstantiated last year — included a staff member supervising more than 14 children by herself on several occasions, staff forced to clean the classroom while providing care and supervision, children crossing the facility parking lot to access the play ground while cars are moving in the parking lot, unqualified staff providing care and supervision, staff operating beyond the terms and conditions of the license, as well as staff not ensuring the facility is properly equipped with supplies.
Attempts to reach Building Kidz of Dublin representatives for comment have been unsuccessful.
Management did put out a statement on the center’s Yelp page on April 16 acknowledging that they “were coping with a tragic event” and were “focused on supporting the immediate family and ask everyone to keep them and the passionate teachers and caregivers who dedicate their lives to the children daily in our thoughts”.
