Cody Hall's charges upgraded to murder, now on "no bail" status

Original post made by Mom, Foothill High School, on Aug 14, 2013

I'm sure PW is writing this story up now, but I know many in this community are following this and want justice for the woman he killed and for her family. Judge Walker had him taken into custody this morning during his hearing after charges were upgraded from vehicular manslaughter to murder. He's apparently been placed on a "no bail" status.

I want the family of the victim to know that this community supports them and that it appears that our local DA does too by rightfully upgrading the charges.

Yes, the charges were upgraded from vehicular manslaughter to murder. Vehicular manslaughter is charged in the case of a death caused by the "negligent" operation of a motor vehicle. For a charge of murder, there has to be the intent to kill OR a "reckless indifference to an unjustifiably high risk to human life (sometimes described as an "abandoned and malignant heart")" (Wikipedia: Murder Web Link ).

Apparently, the DA's office felt that the driver's behavior crossed the line from mere "negligence" to "reckless indifference" to the lives of others on the road. I agree. Causing a death while going, say, 10 to 15 mph over the 40 mph speed limit might be described as "negligent" operation of a car. But going 43 mph over the 40 mph speed limit (that is, 83 mph) definitely qualifies as "reckless indifference" to the lives of all others on the road. Just glad that he didn't mow down an entire family of bicyclists while he was pulling this stunt.

Ok pathetic p-town peps let begin to take down the 16 year old girl charged with D.U.I. Oh sorry the one who wrapped her car around a tree on september 8, 2013. And yes it was 200 feet away from Cody's ACCIDENT. Well she was lucky and didn't kill someone. Pretty much the same as Cody so let's do it.

Hardly a sensible comparison when there's been no death caused as a result of her chosen action. It's pathetic when someone opts for a deadly roll of the dice as a pattern of indifference.

Ultimately it is the responsibility of the individual to make the correct choices. It is the duty of the parents to raise their children to understand the concept of law, morality and respect for others. Society, community and media should play a more positive role but it isn't our fault collectively when there's an abnormal apple in the basket. Kids need their parents not some McChildcare substitution or band-aid concept. Quit passing the buck or the child as it were and give them the attention that they need. If it means that only one parent can work then so be it.

We can all see what the alternatives are with the hands off method of parenting. You get the all too common school shootings and pill popping apathetic, disconnected, digital cable programmed mutants in place of normal loving children. Turn off the T.V. and the phone and the computer/video games and listen to each other! And you wonder why 'Johnny' has lost touch with reality?

Good call Hugh, no bail for you!

Mr. moyer, Was this 9/8 accident reported somewhere in the Pleasanton Weekly? Can you point us ignorants to an article? Thank you.
