Court officials have pushed back the sentencing date for former BART police Officer Johannes Mehserle, who was convicted of involuntary manslaughter on Thursday for fatally shooting an unarmed passenger early in the morning on Jan. 1, 2009.
The sentencing was originally scheduled for Aug. 6 but is now slated for Nov. 5 at 8:30 a.m., according to representatives for Los Angeles Superior Court.
Mehserle, 28, faces 5 to 14 years for shooting 22-year-old Oscar Grant III on a platform at the Fruitvale BART station after he responded to a fight on a train.
An Alameda County Superior Court judge moved the trial to Los Angeles last year due to the controversy surrounding it and the extensive attention it received in the Bay Area.

Half true. He faces between probation / credit timed serve – 14 years. In the penal code it doesn’t allow for a conviction for gun enhancement under involuntary manslaughter. I wouldn’t be surprised if the gun enhancement is thrown out. Article should mention sentencing was pushed back so both sides can look into the gun enhancement issue in more detail. I bet he gets about 3 years.
