Parents Sue Centerpointe Preschool for Hogtying Child

According to Courthouse News, Centerpointe Preschool and the teacher was sued sometimes last week in Contra Costa County court for the practice of "hogtying." They are suing for:

punitive damages for false imprisonment
battery, negligence
negligent hiring and supervision
fraud
breach of contract
intentional infliction of emotional distress.

In addition, they claim that the preschool director hired an unlicensed person to care for children because of his sexual attraction to the unlicensed teacher. Also, the lawsuit claims that the teacher is pursuing sexual harassment claims against the preschool director.

The link mentions that the preschool is in Pleasant Hill. I just wonder what other facts are incorrect. Centerpointe is in Pleasanton, Alameda County. Source does not seem reputable.

I think it is a typo. They meant Pleasanton, not Pleasant Hill. Maybe they sued in Contra Costa County rather than Alameda County for a valid reason.

Gregory Walston is a real attorney. The web page says he was a former Deputy Attorney General.

Hmmm, I wonder about this.
Centerpointe is in Pleasanton, which is in Alameda county.
The link refers to Pleasant Hill and comes from Courthouse news of Contra Costa County.
My neice goes to Centerpoint. It was not masking tape, it was scotch tape, she was not 'hogtied', and it was not for an hour.
What this teacher did was wrong no doubt, but let's at least have correct facts.

Jeanie, you can get the complaint directly from the Superior Court that the reporter from Courthouse News Service used to do her article and take a look at the entire set of court filings. Courthouse News Service is a national news service with a set of reporters that use the actual court filings for their stories. It is not confined to one county. Courthouse News Service is a nationwide news service for lawyers and the news media. The reporter's article also includes the following from the civil filing:

"On information and belief, Calcagno engaged in this draconian practice because Calcagno viewed naptime as her personal time, and punished and restrained any non-napping child to ensure this. Inexplicably, and on an unknown number of occasions, Calcagno photographed the despondent toddler as she lay there helpless."

If this is reputable than how did they get so much wrong? The county is wrong, the timeline is wrong, the fact of who hired Angela is wrong. Are the lawyers who filed this case complete idiots? I would love to see what was filed at the court, but this article is a joke.

Huh, you can drive to the court to see what is filed.

The article states that Calcagno was unlicensed and the principal administrator represented to the parents that only licensed child care professionals would care for the children. It also states that unlicensed Calcagno was unlawfully allowed to care for a preschool group.

In the past, Centerpointe had a minor care for the school age group and were issued a State violation. The Tri-Valley-Times just yesterday in the crime courts section of the Contra Costa Times reported that there were two instances of recent improper supervision of children. The article is here Web Link and this says the State has confirmed another civil rights citation with a substitute pinching and squeezing a child.

I guess you all can all go and nitpick the Tri-Valley Times reporting as well. Perhaps they have misplaced a comma or two.

Believe me, I know all about the recent violations and what the Times reported. The Times says absolutely nothing about this particular lawsuit. The article courthouse news report has many many basic facts completely wrong. Given that so much of it is wrong why should we believe any of it? It reads like something out of the Jerry Springer show, not at all like a legit news agency. I don't believe everything on the Internet to be true. This article seems bogus. Why hasn't anyone else reported it? I wish someone from a real newspaper would drive to the courthouse because I certainly am not going to do that. If someone reported it correctly maybe then I would believe it.

Huh and others--You should believe that a lawsuit was filed because the lawsuit is on the Contra Costa County website with an assigned case number that is, read slowly.... CIVMSC13-00584. It was filed 3/21/2013 and has been assigned to Dept. 31.

As far your question "Why hasn't anyone else reported it?," actual they have, and a quick search shows it is on the internet in at least 15 places. If you want to ask why the Pleasanton Weekly hasn't reported it, contact the Pleasanton Weekly. I think their email address is [email protected] . If you want to find out why the Contra Costa Times hasn't reported on it, I'm sure you can email them to. While you are at it, you can email the Patch, the San Francisco Chronicle, and whoever you want to.

The real question is whether Centerpointe's type of belief system promotes the alleged criminal's actions and the kinds of knee-jerk denials that we've been witnessing over the past couple of weeks. What a gobble of ostriches!
