Solution to future Budget Deadlocks in CA?

Quoted from Tri Valley Herald article reporting on declaration of fiscal emergency on Thursday:

"Under the declaration, state offices will be closed three days a month to conserve cash. If the Legislature fails to solve the deficit within 45 days, it cannot adjourn or act on other bills until the crisis is resolved."

If we really want a budget delivered on time, wouldn't it make more sense to focus the legislators on this task 45 days BEFORE the deadline instead of giving them 45 days after the deadline before lowering the hammer? If 45 days ago they had been restricted to only budget activities we likely would not be issuing IOUs this week.
