Alameda County court judge again rules in favor of Oak Grove developers

A central reason for the Lin's filing this lawsuit is found in the court filings which argued for an expedited hearing. They apparently feared that Brozosky would win as well as the two incumbents, Sullivan and McGovern. Then, once the election was certified on or about December 2, the new council majority would vote to rescind the DA ordinance, since it was still not signed, the lack of signing persisting apparently in violation of law because the city attorney would not agree by his own volition to sign it despite best efforts by the Lin's attorneys to change his mind.
Since Brozosky lost, the whole thing has less importance. I will be very surprised if the council decides to appeal the judge's decision.
The Lin's are simply trying to secure some of the rights granted to them through a legal process after years of negotiation and compromise. The judge, who has no interest in Pleasanton politics, ruled that the law was in their favor.

Dear Frog: May I suggest you join your friends if you don't like the humans? Or better yet,I heard the state of Ca just passed a proposition. The cage I'd like to put you in is bigger now...you can move your legs and everything!
