Re-Posting: "Obama's Jobs Bill Ensures the Unemployed REMAIN Unemployed"

Earlier today, I posted this COMPLETELY ACCURATE item below...

Do you realize that Obama's Jobs Bill allows and encourages unemployed candidates for jobs to sue prospective employers if these candidates are not hired...based on their claim that they were not hired BECAUSE of their unemployed status!

Think about it. This would create a huge disincentive for any employer to even interview an unemployed person for fear that this person would sue.

The level of deliberate job destruction by Obama and the Democrat party in this country is simply breathtaking.

Thank you for agreeing that this is outrageous. But no, I actually am providing accurate info. To further substantiate it, I am copying the relevant section of this Act below and then will provide you with a link to the entire text of the Act so that you can verify for yourself.

Here is the relevant section of the Act...(Note (2) below.)

SUBTITLE D – PROHIBITION OF DISCRIMINATION IN EMPLOYMENT ON THE BASIS
OF AN INDIVIDUAL'S STATUS AS UNEMPLOYED


SEC. 374. PROHIBITED ACTS.

(a) Employers- It shall be an unlawful employment practice for an employer to--
(1) publish in print, on the Internet, or in any other medium, an advertisement or
announcement for an employee for any job that includes-
(A) any provision stating or indicating that an individual's status as
unemployed disqualifies the individual for any employment opportunity; or
(B) any provision stating or indicating that an employer will not consider
or hire an individual for any employment opportunity based on that individual's
status as unemployed; or
(2) fail or refuse to consider for employment, or fail or refuse to hire, an
individual as an employee because of the individual's status as unemployed;
(3) direct or request that an employment agency take an individual's status as
unemployed into account to disqualify an applicant for consideration, screening, or
referral for employment as an employee.

Amy, so from this section of the Jobs Act which says that a person's employment status cannot be used in making a hiring decision you conclude that unemployed job applicants are encouraged to sue prospective employers if they don't get hired? Is that how your brain works? According to your same logic, you must also be against laws prohibiting racial discrimination in hiring since - according to your own logic - such laws only encourage minorities to sue prospective employers if they don't get hired. In fact, if you were to remain faithful to your own logic, you would have to say that laws against racial discrimination in hiring are wrong because they are a "huge disincentive for any employer to even interview a minority person for fear that this person would sue."

You are right on one point, though: You're not getting an apology from me.

Clueless and unapologetic Sam, there are countless examples of minorities using lawyers to sue claiming racial discrimination for perceived injustices that amount to no more than a slip of the tongue or clerical error. Go look up some cases by googling race baiting. In any case, when it comes to hiring, I always choose the most qualified, as we all should, regardless of race. If that leaves you unemployed Sam, go get some skills and quit making excuses.

dear sam,
sorry, i neglected to tell you that am a VP of HR with over 30 years of experience. my guess is that you are either quite young or simply very naive regarding the world of work, especially in the private sector. i cannot even count the number of employment charges i have been involved in where the person filing the charge has essentially made a living filing bogus suit after bogus suit hoping the employer will settle out of court because it is cheaper than fighting. this pathetic Jobs Bill will only make it that much riskier for employers to interview the unemployed.

So, Amy, I take it from your response that you are against laws prohibiting racial discrimination in hiring.

If so, then you've been living your last 30 years as a VP or HR as a lie. While I disagree with your views about racial discrimination laws in hiring, I would at least give some grudging respect to you if you had openly declared your true views about HR hiring guidelines (which I'm sure include statements against racial discrimination in hiring) to your employer. But you haven't done that, have you? Nor have you tried to find some other line of work which doesn't involve such a strong clash between your own personal views and the openly stated policies of your employer. Again, you have been and continue to live a lie every day you go to work. Mull over that one during your coffee break in your VP of HR office tomorrow.

sam, apparently you didn't get the memo from obama that we're now a post-racial society (his words, not mine).
It's time to stop using race as a crutch or an excuse for not being able to compete. I'm sure you must admire folks like John Burris, Al Sharpton and Jesse Jackson---it must be the capitalist in you, since they've all been successful making a lucrative business out of the race game. I guess everyone has to make a living, but you race baiters are the lowest form of parasite on the earth. I'm sure you can do better if you try, race aside.
