Original post made on Jan 13, 2014

In a final ruling that could affect older homes in Pleasanton, a Superior Court judge in San Jose increased the amount that three large corporations must pay to eliminate lead paint from 3.5 million old homes in eight California counties as well as San Diego and Oakland to $1.15 billion.

If the company knew (or "should have known") they were selling a product that could cause harm, that is one thing. If no such knowledge existed at the time of the sale, then this is retroactive application of the law. By such reasoning, everyone of us who once drove a car that emitted harmful pollutants that would not be permitted by current law, should be held responsible for the damage such pullutants may have caused or might cause in the future, including the inspections of every living and deceased person who may have been harmed by such pollutants.

Pretty hard to believe companies didn't know what they were doing. I had read about lead-based paint in low-income houses and apartment bldgs. as far back as the early 1960s. Here and now? The companies, shamelessly uncaring about the effects of chipped lead paint in family homes, made off like bandits. Note too that it has taken 13+ years for there to be a resolution. Wanna bet the housing companies were paying high-priced lawyers to delay the case for as long as possible? It's amazing what love of the buck will make people do; and it's truly unfortunate that our economic system encourages wanton violence upon others for the sake of making a profit.
