The shoplifting case involving state Assemblywoman Mary Hayashi will return to court today for the first time since she pleaded not guilty last month to trying to steal about $2,500 worth of clothing from a Neiman Marcus store in San Francisco.
Hayashi, (D-18th) was arrested on Oct. 25 after a security
officer at the Union Square store stopped her because she was leaving the store with three items worth $2,445 that she hadn’t paid for, prosecutors said.
The 45-year-old assemblywoman pleaded not guilty to a felony grand theft charge on Oct. 27 and was released on $15,000 bail.
Hayashi’s spokesman Sam Singer said the incident was “a mistake and misunderstanding,” saying that she carries two cellphones and was texting and phoning with a bag in her hands and inadvertently stepped outdoors.
The case is returning to San Francisco Superior Court today to set a date for a preliminary hearing.
Hayashi was elected in 2006 to represent the 18th Assembly
District, which includes Pleasanton, Hayward, Castro Valley and Dublin.
She is a member of the leadership team for Assembly Speaker John Perez, serving as chair of the Assembly Committee on Business, Professions and Consumer Protection.

It’s always a mistake and misunderstanding when you get caught red-handed. If she’s not found guilty, we’ll know it’s because of her or her husband’s influence – all of these corrupt Democrat judges protect their own.

BTW, I seem to remember that the last Republican that I voted in for California Governor ran into some problems. What was it? Something about impregnating his housekeeper? On the sleaziness scale, I would say that even beats a shoplifting accusation.

Cholo, my point is simply that neither side – Republican or Democrat – can claim any sort of moral superiority over the other side. There’s plenty of corruption on both sides, and only the fools here think otherwise.

If she is sincere about her innocence, then let this go to a full trial.
IF she is sincere she will not accept a plea to a lesser charge.
If she accepts a plea or is found guilty of the felony, then she should never be elected to anything in the future.
Currently she has been raising funds for a State Senate race in the future. About $200,000.
Treat her like any teenage girl who could also use the excuse of “texting and calling” “inadvertently leaving the store”

Sam, you don’t know what you are talking about. Steve is correct. No grand jury or indictment or arrest indicates that the governor broke any law. Hayashi has an arrest and an upcoming preliminary hearing. And PA is investigating exactly who violated the Pennsylvania child mandated reporter laws.

Actually, calling anything on these sites a “debate” is a bit far-fetched. What we have here is a right-wing hatefest. Whine about this, complain about that, hate this, disgusted by that, I’m miserable, wish I were some of the people I’m complaining about…. And on and on we go. As chair of the Assembly Committee on Business, Professions and Consumer Protection, she should have simply declared it Buy Something Get Something Free Day. Then she could get away with it just like congress has written the law to make insider trading legal for only them. Both dems and republican representatives are getting rich off that one.

The biggest obstacle to real justice in our community is liberal laws, and liberal courts, and liberal criminal justice system. Due process? Most of us stay out of trouble and don’t need due process. If the police arrest you, then as my esteemed father used to say, “You are probably guilty as sin.”
Sarah Palin has the right idea. “I would like to see the players not suffer more than they have suffered. Same thing with Hayashi. Who needs a courtroom when I know she’s guilty? I would never get so distracted to forget to pay for items in the store. I’m too concerned about my own money. And so since everyone in this world is like me, then Hayashi is guilty. You expect my taxdollars to pay for the judge and jury and prosecutor and the courtroom proceedings and…. Well just like Sarah says about Sandusky, I say the same thing about Hayashi. She’s a sinner and should be treated to taxpayer justice. I’ll bring the rope!
And just wait and see. This foreigner who snuck into office (birth certificate anyone?) is going to collect a HUGE pension after she retires. I don’t get a huge pension. Why should anybody else, especially this sinner?

Bottom line is that if any one of us had been arrested for this sort of crime, a felony, our a**es would have been required to be there. I agree with the others on the other thread saying she needs to experiece what anyone else would whether innocent or guilty. It’s pathetic that she’s getting special treatment when in her role as a community leader, if anything she should be treated by the book and under a microscope. Her spokesperson is already litigating this in the media to the public. Would any of us have a spokesperson to do this for us if we were arrested on felony grand theft? I think not.
Even if you believe her story, c’mon, who puts $2,500 worth of unpaid merchandise in a bag to accidentally walk out with. TRUE STORY…, I was at Nordstrom in SF on Market Street last weekend shopping for my daughter when the pager from the cafe went off letting me know my seat was open. Well guess what, I didn’t use this as an excuse to put unpaid merchandise in my bag. Instaed, the lady helping me offered to ring up my purchases for me while I went to the cafe and said she’d then deliver them to me there. And that’s exactly what happened. Oh yeah, she also immediately called the cafe and let them know I was walking over and to hold my table. Nordstrom is no Nieman Marcus so if Nordstrom could do something like this, surely Nieman Marcus could have.
Bottom line, even with her media machine working overtime, her story makes no sense and I think the video will lead to her undoing IF SHE IS EVERY TREATED LIKE THE THE REST OF US AND NOT HAVE THIS SWEPT UNDER THE RUG.
Yes, Michelle is so right. Hayashi is just like us. If this had happened to me or you, we’d be subject to the same kind of prejudgement (prejudice) on this post as Hayashi has gotten.
Face it. She’s guilty of being a successful Korean-American politician. She’s guilty of being a Democrat. She’s guilty of shopping at an expensive store. She’s guilty of intending to make a clothing purchase of around 2500.00. She’s guilty of having her lawyer submit a plea. She’s guilty because her husband is a judge. Why even bother to have a trial? Who needs one? All of us good, upstanding Pleasantonians have already decided she is guilty as sin. Save our tax dollars (especially mine)! Lock her up and forget about her!
